Collection and transfer of personal data

It is possible to merely visit our website www.gearrilla.com without providing personal data.

As explained separately below, different rules may apply to the use of individual functions on our website. Your personal data (e.g. name, address, email, telephone number, leased or rented items and comparable information) will only be processed and stored by us pursuant to the provisions of German data protection law. Data are considered “personal” if they can be clearly attributed to a specific natural person. The legal basis for data protection can be found in the Federal Data Protection Act (Bundesdatenschutzgesetz; BDSG) and the Telemedia Act (Telemediengesetz; TMG). The provisions below inform you about the type, scope and purpose of our collection, use and processing of personal data as well as about the criteria for determining the duration of the storage of personal data.

We would like to point out that Internet-based data transmission entails security gaps and therefore seamless protection against access by third parties is impossible.

Registration function

We offer you the option to register on our website ("sign up"). The data entered in the course of this registration, which can be seen in the input mask of the registration form (email address, password), are collected and stored exclusively for the use of our offerings based on your corresponding consent. When you register on our site, we also store your IP address and the date and time of your registration. This serves as security for us in the case a third party misuses your data and registers with these data on our site without your knowledge. The data are not passed on to third parties. No reconciliation takes place of the data collected in this way with data possibly collected by other components of our site.

Payment processing

If you choose a payment method from the payment service provider Adyen, the payment will be processed by the payment service provider Adyen, Simon Carmiggeltstraat 6 - 50, 1011 DJ Amsterdam, the Netherlands, to whom we will forward the information you provide during the ordering process together with the information about your order (name, address, IBAN, BIC, invoice amount, currency and transaction number) in accordance with Art. 6 para. 1 lit. b DSGVO. The transfer of your data takes place exclusively for the purpose of payment processing with the payment service provider Adyen and only to the extent that it is necessary for this purpose.

Referral function

Please note that when using the referral function, you are responsible for ensuring that the referral e-mail is forwarded in accordance with data protection laws. This means: Please make sure in advance that the contact you have referred has agreed to receive such an e-mail.

Letting and renting of articles

If you let or rent items via Gearrilla, we collect, based on your consent, the data necessary to process these transactions, namely your contact and address data, your payment information and the articles you have let or rented.

In order to enable a contract to be concluded in accordance with the General Rental Terms and User Information of www.gearrilla.com , we enable the exchange of lessor and tenant data in accordance with this data protection declaration.

Contact option

We offer you the option on our website to contact us via email and/or a contact form ("Contact"). In this case, the information you provide will be stored based on your consent for the purpose of processing your contact. The data will not be passed on to third parties. No reconciliation takes place of the data collected in this way with data possibly collected by other components of our site.

Comments option

We offer you the option to leave comments about the individual contributions on our website. The IP address of the author/connection owner is stored when doing so. This storage is undertaken for our security in the event the author infringes third-party rights and/or posts unlawful content. We therefore have a vested interest in the stored data of the author, especially since we may be prosecuted for any such rights infringements. No reconciliation takes place of the data collected in this way with data possibly collected by other components of our site.

Subscription to comments

We offer you the option on our website to subscribe to follow-up comments on contributions about which you comment. If you choose this option, you will receive a confirmation email verifying that you are the actual owner of the email address provided. The decision to subscribe to such follow-up comments can be cancelled at any time. Details can be found in the confirmation mail. The data thus obtained will not be passed on to third parties. No reconciliation takes place of the data collected in this way with data possibly collected by other components of our site.

Shipping of gear

If a lessor decides to ship an item, we will pass on the lessor’s address and the address of the tenant to the shipping company DHL.

Anonymized user profile

We reserve the right to create anonymous user profiles (e. g.: number of rented tents in Frankfurt broken down by month) from the information available to us and to process these anonymous profiles for statistical purposes, for example. If we have created an anonymous user profile, it is not possible for us or for third parties to reanonymize such profile.

Deletion of your data

We delete the personal data you have transmitted to us when such data no longer need to be stored (e.g. for the processing of a rental agreement) and when we are no longer legally obliged to do so.

In this way, we will delete the name and email address you entered when you registered, if you delete your account. If a contract has been concluded between users of Gearrilla for which a commission claim has arisen, we store the information on this concluded contract for 6 years, calculated from the end of the year in which the corresponding rental agreement was concluded. We also store other business correspondence for 6 years, calculated from the end of the year in which such business correspondence originates.

Use of Google Analytics with anonymization function

We use Google Analytics, a web analytics service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA (hereinafter, "Google"). Google Analytics uses "cookies", which are text files placed on your computer to help you analyze how users use the site.

The information generated by these cookies, such as the time, location and frequency of your website visits, including your IP address, is transmitted to and stored by Google in the United States.

We use Google Analytics on our website with the addition "_gat. _anonymizeIp". In this case, Google already shortens your IP address within EU member states or in other signatory states to the Agreement on the European Economic Area, thus rendering it anonymous.

Google uses this information to evaluate your use of our website, to compile reports on website activity for us and to provide other services relating to website and Internet usage. Google may also transfer this information to third parties if required by law or if third parties process these data on behalf of Google.

Use of Google+ recommendation components

On our site, we use the "G+" button of the provider Google+ from Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA (hereinafter, "Google").

Each time our website receives an access request equipped with such a "G+" component, this component prompts your browser to download a corresponding image of the component from Google. This process informs Google which specific page of our website is currently being visited.

According to Google, no further evaluation of your visit takes place if you are not logged into your Google account.

If you visit our site while logged into Google, Google may collect information about your Google account, the site you are recommending, your IP address and other browser-related information when you click the “G+” button.

In this way, your "G+" recommendation can be saved and made available to the public. Your Google "G+" recommendation submitted in this way can then be displayed as a notice along with your account name and, if applicable, your Google photo in Google services, e.g. in search results, in your Google account or at other locations such as websites and ads on the Internet. If you access our site while logged into Facebook, Facebook will recognize the specific page you are visiting through the information collected by the component and will allocate this information to your personal account on Facebook. Use of Google AdSense

We use Google AdSense on our website. Google AdSense is a service of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, to integrate advertisements. Google-AdSense uses so-called "cookies", i.e. text files that are stored on your computer and allow an analysis of the use of our website. Google AdSense also uses web beacons. The Mixpanel service protocols page views and page activity. To enable this, log data is transmitted to Mixpanel (and Mixpanel Inc.). Specifically, the following data is stored when individual pages of our website are accessed: two bytes of the IP address of the user's calling system, the web page accessed, the website from which the user arrived to the web page accessed, the sub-pages accessed from the web page accessed, the time spent on the web page and the frequency of access to the web page. This website uses Inspectlet, a web analytics service provided by Inspectlet Inc., California, USA ("Inspectlet"). However, Inspectlet does not collect your IP address. We use Inspectlet to analyze the use of the website and to continually improve and make our site more user-friendly.
